domestic violence

The state of Florida defines domestic violence as any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member.

It’s important to note that “family or household member” means spouses, persons related by blood, exes, persons living together as a family, and parents of a child in common.

Unfortunately, domestic violence is a very common occurrence in the U.S. and in Florida, and domestic violence battery is the most common of all the different types of domestic violence.

Because of the private nature of these offenses, many state attorneys offices have specialized units that handle these cases. If you've been charged with a domestic crime, chances are there are multiple sides to the story. Having an experienced defense attorney tell your side is always better than making statements yourself. We can also craft a defense that will diminish or dismiss the domestic charges against you. Some defenses against domestic violence include self defense, stand your ground, defense of others or mutual combat.

Another challenge of being arrested for domestic violence is that the conditions of your release prohibit you from returning to your home or having any contact with the alleged victim. A lawyer can help you request a modification to your release conditions so you can return home or have mediated contact with the alleged victim.

Whatever your situation, do not ignore your domestic violence charges. The penalties for a domestic violence conviction can be hefty, but they're potentially avoidable with the right criminal defense attorney. if you've been accused of domestic violence in Orlando, Sanford, Deltona, DeLand, New Smyrna Beach, Daytona or any surrounding areas call me today for a free consultation - 386.843.0593.
